Areas of Practice
Special Education Law & Student Rights
We advocate for parents and students in disputes involving special education services, accommodations, and procedural protections under the Individuals with Disabilities Education Act (IDEA), Section 504 of the Rehabilitation Act, and the Americans with Disabilities Act (ADA).
IEP & 504 Plan Advocacy: Reviewing, drafting, and enforcing Individualized Education Programs (IEPs) and 504 Accommodation Plans.
School Meetings & Due Process: Representing families at Team meetings, resolution sessions, mediation, and formal due process hearings.
Placement & Service Disputes: Resolving disagreements over least restrictive environment (LRE) placements, compensatory education, or related services like speech and occupational therapy.
Discipline & Manifestation Determination: Protecting students with disabilities during disciplinary proceedings, suspensions, and Manifestation Determination Reviews (MDR).
Transition Planning: Securing appropriate post-secondary education, vocational, and independent living transition services.
Federal Workers’ Compensation (FECA / OWCP)
We represent injured federal civilian employees navigating the Office of Workers’ Compensation Programs (OWCP) under the Federal Employees' Compensation Act (FECA). Unlike state systems, federal injury claims follow strict administrative rules that demand precise legal and medical documentation.
FECA & OWCP Claim Appeals: Challenging adverse decisions through Requests for Reconsideration, Reviews of the Written Record, and Employees' Compensation Appeals Board (ECAB) appeals.
Overpayment Defense & Waivers: Challenging inaccurate OWCP overpayment calculations and preparing Waiver Applications (Form OWCP-20) based on financial hardship and "without fault" standards.
Wage-Loss & Benefit Disputes: Resolving wage-loss calculation errors, Schedule Award claims for permanent impairment, and improper benefit reductions or terminations.
Medical Rationale Guidance: Working directly with treating physicians to craft comprehensive narrative reports that meet OWCP's strict causal relationship standards.
Social Security Disability Appeals (SSDI / SSI)
If your application for Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) was denied, you do not have to navigate the administrative process alone. We help claimants build the strong medical and vocational record needed to secure benefits.
ALJ Hearing Representation: Preparing comprehensive pre-hearing briefs and advocating for you during virtual or live hearings before an Administrative Law Judge (ALJ).
Appeals Council & Federal Court Review: Challenging improper ALJ denials through the SSA Appeals Council and filing federal court appeals when legal errors occur.
Medical Record & Brief Strategy: Analyzing complex medical histories, obtaining supportive physician statements, and identifying listing-level impairments or vocational limitations.
ADA / Reasonable Accommodation & Workplace Disability
We protect the rights of individuals with disabilities in the workplace and public spaces under Title I and Title III of the Americans with Disabilities Act (ADA), Section 504, and state anti-discrimination laws. We also assist employees navigating private disability insurance policies.
Workplace Reasonable Accommodations: Advising and representing employees requesting job modifications, remote work, specialized equipment, or extended medical leave under the interactive process.
Disability Discrimination & Retaliation: Challenging adverse employment actions, failure-to-accommodate decisions, and improper fitness-for-duty evaluations.
Short-Term & Long-Term Disability Appeals (STD/LTD): Representing employees in ERISA and private insurance appeals when short-term or long-term disability benefits are wrongfully denied or cut off.
Access Barriers: Enforcing equal access and modifications in educational institutions, workplaces, and public facilities.
